BREAKING: Sandiganbayan acquits Elenita Binay over 13.25-M graft case

The  Sandiganbayan has acquitted former mayor Elenita Binay of graft over  the purchase of office fixtures and furniture for the new Makati City  Hall worth P13.25 million.

In its decision, the dispositive part  of which was read during the promulgation of judgment Thursday, the  anti-graft court said the prosecution "failed to establish the elements  for which [the accused] were charged]."

Two of Binay's co-accused  in the case, former councilor and general services chief Ernesto  Aspillaga and Vivian Edna Edurise, were similarly acquitted of the graft  charge.
Binay was present at the promulgation.

The graft  case against Binay before the Fourth Division stemmed from the purchase  of office fixtures and furniture for the new Makati City Hall from  private contractor Office Gallery International between December 1999  and February 2000.

Based on a report submitted by a team of  government auditors, the acquisitions worth P13.25 million was  overpriced by P3.6 million.
